Civil Rights & Labor Advocacy Groups Want to  End Pre-Employment Credit Checks

A recent article in the Huffington Post, a coalition of 25 civil rights and labor advocacy groups have petitioned TransUnion—one of the nation's largest credit-monitoring firms and the only privately-held company of the so-called ‘Big Three’—to stop providing credit reports and credit information to employers to use as part of the pre-employment screening process.

California Legislation on Credit Reports & E-Verify

This month California Governor Jerry Brown signed two Assembly Bills: ‘AB 22’, which prohibits most employers or prospective employers from obtaining consumer credit reports for employment purposes, and AB 1236, the Employment Acceleration Act of 2011, which prevents state and local governments from requiring California businesses to use E-Verify to check if newly hired workers are legally eligible to work in the United States. The new laws take effect January 1, 2012.

Congress Takes a Stand on Social Media Use in Background Checks

U. S. senators has weighed in on the practice of using social media as a background screening tool. In September of this year U.S. Senators Richard Blumenthal (D-CT) and Al Franken (D-MN) expressed their concern that the gathering and reporting of social media activity to employers could harm individuals seeking employment for positions where a background check includes social media information.

Credit Scores and Adverse Action

The most recent Dodd-Frank Act amendment to the Fair Credit Reporting Act (FCRA) deals with the use of credit scores by anyone who takes adverse action based on the scores. Employers that use a consumer report that includes a credit score in a hiring decision must disclose that it used a credit score and disclose information on the credit score. The new amendment became effective in July 2011.

EEOC proposes ban on retail background checks

The Equal Employment Opportunity Commission (EEOC) announced its plan to ban criminal background checks on job applicants and current employees in the restaurant industry, as part of the applicant background check process, causing an outcry from the background screening industry and employers.
